The parties hereby acknowledge that each is subject to the Upstate New York Gaming Economic Development Act and the rules and requirements of the New York State Gaming Commission including the provisions of Article 15-A of the New York State Executive Law and the rules and regulations set forth in Parts 140 through 144 of Title 5 of the New York Rules, Regulations and Codes. Consultant is required to maximize the purchase of goods, services and supplies from contractors or vendors who meet the definition of Minority-owned (MBE) and Women owned (WBE) (collectively known as Diversity Businesses) to meet a combined goal of 30% MBE and WBE participation as well as Equal Employment Opportunities (EEO) workforce goals of 30% MBE and WBE. This information will be reviewed by both the New York State Gaming Commission and Capital Region Gaming, LLC for acceptance. This Agreement may be disclosed to and subject to approval of the New York State Gaming Commission.
